By accessing our website or placing an order, you confirm that you are at least 18 years of age and agree to be bound by these Terms. If you do not agree, please do not use our website or purchase our products.

2. Definitions

In these Terms, the following definitions apply:

  • ‘WDA Willow’, ‘we’, ‘us’, ‘our’ refers to WDA Willow (Registration No: 15662324)
  • ‘You’, ‘customer’, ‘buyer’ refers to the individual or entity purchasing from us
  • ‘Products’ refers to cricket bats, willow clefts, accessories, and any other items available on our website
  • ‘Custom Order’ refers to any bat or product manufactured to your specific requirements
  • ‘Website’ refers to wdawillow.co.uk and all associated pages
  • ‘Contract’ refers to the agreement formed between us when we confirm your order

3. Use of Our Website

You agree to use our website only for lawful purposes and in a manner that does not infringe the rights of others. You must not:

  • Use the website in any way that breaches applicable local, national, or international law

  • Attempt to gain unauthorised access to our systems or data
  • Use automated tools to scrape, copy, or reproduce content from our website

4. Products and Orders

4.1 Product Descriptions

We make every effort to ensure that product descriptions, images, and specifications on our website are accurate. However, due to the natural variation in English willow, slight differences in grain pattern, colour, and texture may occur between individual bats. These variations are a natural characteristic of premium willow and do not constitute a defect.

4.2 Placing an Order

By placing an order on our website or via direct communication, you are making an offer to purchase products subject to these Terms. All orders are subject to availability and acceptance by WDA Willow. We reserve the right to refuse or cancel any order at our discretion.

4.3 Order Confirmation

An order is confirmed only when you receive a written confirmation from us via email. This confirmation constitutes acceptance of your offer and forms a binding contract between you and WDA Willow.

4.4 Pricing

All prices are displayed in British Pounds Sterling (GBP) and are inclusive of VAT where applicable. We reserve the right to change prices at any time without prior notice. The price applicable to your order is the price confirmed at the time of your order confirmation.

4.5 Availability

All products are subject to availability. If a product becomes unavailable after your order has been confirmed, we will notify you promptly and offer an alternative, an amended delivery timeline, or a full refund.

5. Custom Bat Orders

WDA Willow offers fully bespoke cricket bat manufacturing services. The following terms apply specifically to custom orders:

  • Custom orders are confirmed only upon receipt of a non-refundable deposit of 50% of the total order value
  • You are responsible for providing accurate specifications at the time of ordering, including weight, handle type, blade profile, and any other requirements
  • Once production has commenced, changes to specifications cannot be guaranteed and may incur additional charges
  • Lead times for custom bats are typically 2 to 6 weeks from deposit confirmation, depending on order volume and complexity
  • Custom-made products cannot be returned or refunded unless they are found to be defective (see Section 8)
  • WDA Willow reserves the right to make minor adjustments to specifications where the chosen willow characteristics require it, and will consult you where possible

We strongly recommend discussing your requirements with our team before placing a custom order to ensure the final product meets your expectations.

6. Payment

We accept payment via the methods listed on our website, which may include credit/debit cards and bank transfer. Payment must be received in full (or as a deposit for custom orders) before production or dispatch begins.

All transactions are processed securely. We do not store your card details. Payment processing is handled by accredited third-party payment providers.

In the event of a failed or disputed payment, we reserve the right to withhold or cancel your order until payment is resolved. Any bank charges or currency conversion fees are the responsibility of the buyer.

7. Shipping and Delivery

Delivery timelines and charges are detailed in our Shipping & Delivery Policy, which forms part of these Terms. By placing an order, you also agree to the terms of our Shipping & Delivery Policy.

Key points include:

  • Estimated delivery timelines are provided in good faith and are not guaranteed
  • Risk of loss or damage to products passes to you upon delivery
  • WDA Willow is not responsible for delays caused by courier services, customs, or circumstances beyond our control
  • It is your responsibility to ensure the delivery address provided is accurate and accessible

8. Returns and Refunds

Our Returns & Refunds Policy governs all return and refund requests and forms part of these Terms. Key provisions are:

  • Standard (non-custom) products may be returned within 14 days of receipt, provided they are unused and in original condition
  • Custom-made bats are non-refundable except in the case of a manufacturing defect
  • Refunds are processed within 14 business days of receiving the returned item
  • Return shipping costs are the responsibility of the customer unless the item is faulty

9. Warranty and Product Defects

All WDA Willow products are crafted to the highest standards using premium English willow. We offer the following warranty:

  • Each bat is warranted against manufacturing defects for a period of 6 months from the date of delivery
  • The warranty does not cover damage caused by misuse, improper knocking-in, use with non-leather balls, or normal wear and tear
  • Natural willow characteristics such as surface cracking, minor grain separation, or discolouration that do not affect performance are not considered defects
  • To make a warranty claim, please contact us at malik@wdawillow.co.uk with proof of purchase and photographic evidence of the defect

We reserve the right to repair, replace, or refund the product at our discretion upon validating a warranty claim.

10. Intellectual Property

All content on our website, including but not limited to text, images, logos, product designs, and graphics, is the intellectual property of WDA Willow or its licensors and is protected by applicable copyright and trademark laws.

You may not reproduce, distribute, modify, or use any content from our website for commercial purposes without our prior written consent. Unauthorised use of our intellectual property may result in legal action.

11. Limitation of Liability

To the fullest extent permitted by applicable law:

  • WDA Willow shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our products or website
  • Our total liability to you in connection with any order shall not exceed the total amount paid by you for that order
  • We do not exclude liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under English law

Nothing in these Terms affects your statutory rights as a consumer under the Consumer Rights Act 2015 or other applicable UK consumer protection legislation.

12. Your Statutory Consumer Rights

If you are purchasing as a consumer (not in the course of a business), you have statutory rights under UK law, including:

  • The right to receive goods that are of satisfactory quality, fit for purpose, and as described
  • The right to a repair, replacement, or refund if goods are faulty
  • A 14-day cooling-off period for standard (non-custom) orders placed online under the Consumer Contracts Regulations 2013

These statutory rights are not affected by anything in these Terms.

13. Force Majeure

WDA Willow shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, strikes, supply chain disruptions, government restrictions, or acts of God.

In such circumstances, we will notify you as soon as reasonably practicable and will endeavour to fulfil our obligations as soon as the situation allows.

14. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer, you may also have access to alternative dispute resolution (ADR) schemes. For more information, visit the UK Government’s online dispute resolution platform.

15. Changes to These Terms

We reserve the right to update or amend these Terms at any time. Any changes will be posted on this page with an updated ‘Last Updated’ date. Continued use of our website or placing of orders after changes are posted constitutes your acceptance of the revised Terms.

16. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

17. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, Shipping & Delivery Policy, Returns & Refunds Policy, and Custom Bat Policy, constitute the entire agreement between you and WDA Willow in relation to your use of our website and the purchase of our products. They supersede all prior agreements, representations, and understandings.
